Two Men Convicted of Sex Abuse The Decatur County Attorney's Office released the following information regarding a recent jury trial held in the court room of the Decatur County Courthouse. On Monday, September 23, 2019, after a brief deliberation, a Decatur County jury found Justice Mathis (19) and Mickie Lee Atkins (50), both currently of Mt. Ayr (formerly from Lamoni), guilty of all charges. Mathis was convicted of three (3) counts of Sex Abuse in the Second Degree and Atkins of two (2) counts of the same offense involving the same minor victims. Each count of Sex Abuse in the Second Degree carries a potential imprisonment of up to twenty-five years. Additionally, there is a mandatory minimum sentence of 70% before being eligible for parole. The two are scheduled for sentencing in November. At that time, the Judge will decide whether the sentences will run concurrent or consecutive and whether Mathis is eligible for modified (continued on page 5)

Chief Thomas' Use of Deadly Force Justified County Attorney Lisa Hynden Jeanes released the following information: Following a full investigation by the Division of Criminal Investigation, criminal charges will not be filed against Leon Police Chief Jon Thomas relating to the shooting of Patrick Bauer on July 7, 2019. On that date, at or about 3:00 a.m., Chief Thomas was on routine patrol in the 300 block of NW 3rd Street in Leon. He encountered a vehicle being driven by Patrick Bauer and initiated a conversation with him from his patrol car. During the initial, amicable conversation, Chief Thomas learned that there was a warrant for Bauer’s arrest out of Missouri. Bauer, standing at the driver’s side door of Thomas’

patrol car, with the window down, heard the radio traffic indicating he was wanted. Before Chief Thomas could take any action, Bauer sprayed him in the face with a chemical agent, temporarily blinding him. Chief Thomas, still seated and seat belted in his patrol car, unable to see and having difficulty breathing, could feel the pressure of Bauer’s hand on his chest, and believed Bauer was attempting to disarm him or obtain a weapon to use against him. Chief Thomas drew his weapon and fired multiple shots out the driver’s side window of his patrol car. Bauer retreated to his vehicle, but Thomas assessed he was

The rest of the family stayed at Lamoni while Newton served in the Army Air Corp for a short time. In the early 1970’s they moved to Weldon, Iowa. In 1989, Newton, Jean, and Ann moved to Van Wert, Iowa. Jean was a wife, mother, and homemaker for her family. She always raised a large garden and canned the fruits of her labor. She also enjoyed sewing and quilting. Preceding her in death were her parents; husband, Newton on October 12, 2009; son, Junior in 1968; great grandson, Jacob Miller; and her siblings, Melba Swigart, Verle Argabright, Johnny Argabright and Gretchen Hagen. Survivors include her daughters and son-in-law, Connie and Gareth Deemer of Weldon and Ann Gray of Van Wert; three grandchildren, Duane Deemer of Crossville, Tennessee, Darla Miller of Odell, Nebraska, and Carla Deemer of Ankeny, Iowa; great grandchildren, Logan and Megan Deemer of DeSoto, Iowa, Talon and Hagit Deemer of Yardley, Pennsylvania, Kristina Miller and Adam Miller, both of San Diego, California; great, great grandchildren, Tayden and Ayla Deemer and twins, Carson and Sophia and Hadley Deemer; sister, Shirley Gross of Ponca City, Oklahoma; nieces and nephews; and other relatives and friends.

Josephine LaVerne Caylor was born in Creston, Iowa on August 10, 1951, the daughter of Bedrick Joseph and Lenora (Kohl) Pashek. Jo was educated in the Creston Public Schools and graduated from Creston High School with the Class of 1970. Following high school, Jo moved to Osceola and went to work for Furnas Electric/Siemens. She worked as an Assembler making Thermostat Controls and Pressure Switches. Later, when the company closed and moved to Mexico, Jo went to work for Bunn-O-Matic in Creston. She worked for Bunn approximately 10 years until ill health forced her to retire. Jo was united in marriage to Larry Joe Caylor in November of 1993 in Leon, Iowa. Larry became a stepfather to Jo's son, Chad and Jo became stepmother to Larry's son, Thad. Jo loved gardening and was always tending to her large vegetable and flower gardens. She was an excellent seamstress, a wonderful cook and enjoyed traveling to various places in the continental United States. Jo lived the majority of her adult life in Osceola until moving to Creston for the last 2 1/2 years. Jo's husband, Larry, preceded Jo in

Submit Loan Requests for Financing Early The Farm Loan team in Clarke-Decatur County is already working on operating loans for spring 2020 so it is important that potential borrowers submit their requests early so they can be timely processed. The farm loan team can help determine which loan programs are best for applicants. FSA offers a wide range of low-interest loans that can meet the financial needs of any farm operation for just about any purpose. The traditional farm operating and farm ownership loans can help large and small farm operations take advantage of early purchasing discounts for spring inputs as well expenses throughout the year. Microloans are a simplified loan program that will provide up to $50,000 for both Farm Ownership and Operating Microloans to eligible applicants. These loans, targeted for smaller operations and non-traditional operations, can be used for operating expenses, starting a new agricultural enterprise, purchasing equipment, and other needs associated with a farming

operation. The staff at the Clarke-Decatur County FSA office can provide more details on farm operating and microloans and provide loan applications. Loans to beginning farmers and members of underserved groups are a priority. Other types of loans available include: Marketing Assistance Loans allow producers to use eligible commodities as loan collateral and obtain a 9-month loan while the crop is in storage. These loans provide cash flow to the producer and allow them to market the crop when prices may be more advantageous. Farm Storage Facility Loans can be used to build permanent structures used to store eligible commodities, or for storage and handling trucks, or portable or permanent handling equipment. A variety of structures are eligible under this loan, including bunker silos, grain bins, hay storage structures and refrigerated structures for vegetables and fruit. Nullification as a Solution to Judicial Overreach to be Presented at Local Tea Party Meeting Submitted by Len Edwards Steve McCoy and Don Jennings will be speaking about a legal theory called State Nullification at our regular tea party meeting on October 8th (7 to 8:30 PM at the Lamoni Community Center). These men have studied the issue for years and think that with courageous leadership, it can be a useful tool that will help insure that whatever legislation and/or court decisions made by the federal government is within the bounds of

the Constitution. The members of our tea party are not advocating state nullification as a valid counter to judicial and/ or congressional overreach. But, we think that it is information that should be made available and considered as we seek to grapple with state and federal systems that often seem all too willing to step out of constitutional bounds. TWICE TOLD TALES 20 YEARS AGO (September 29, 1999) Homecoming 1999 queen candidates were: Brandi Deemer, Lauren Pierpont, Stephanie Handrock and Kristen Denny; king candidates: Noah Thomas, Jimmy Christofis, Logan Helton and Andy Redman. Class attendants were freshmen: Jay Olsen and Megan Denny; sophomores: Tyler Norman and Kelsie Vanderflute; and juniors: Garrett Saxton and Jill Walderbach. Kristen Denny and Andy Redman were crowned Queen and King. Crown bearers were Matthew Petty and Amy Halverson. Nick Morell, rural Grand River, was appointed to fill the vacancy on the CD School Board in Director District 3. Van Wert and Davis City both were building a new community building. The Motor-Ioway 1999 Tour came through Leon on Highway 69 on Sunday, October 3, en route from a lunch break in Osceola to an afternoon pit stop in Lamoni. Approximately 200 vehicles were expected to participate in the fourth annual, seven day vintage motor tour through the scenic fall landscape of Iowa. Decatur Elementary School had new playground equipment. Several volunteers, Mike Durell, James Cornell, Jerry Parsons, Ed and Laurie Palmer, Dennis Christensen and Doyle South, gathered at Noel Park to install the new playground equipment made possible through a Carver Charitable Trust grant. The Leon Lions Club installed a flag pole on the Central Decatur baseball field. Another flag pole was installed earlier in the year on the softball field. Both poles were placed in memory of a long time Lions member, Brown Rhodes. Lions Club was represented by members: Dan Porter, Roger Queck and Earl Hanthorn. Decatur County Farm Bureau officers: Directors - Cindy Stark, Sheila Overton, Diane Cornett, Rex Waller, Darlene Sellers, John Rippey and Sam Mendenhall; Ronald Deemer, voting delegate; Leon Kessel, president; Shirley Kessel, secretary; and Fred Cox, treasurer.

Patrons of the Leon Post Office were above average throughout the nation in their use of the zip code on their first class mail stated Garth Mitchell, postal clerk. Mitchell said that 80 percent of the first class mail had the zip code as part of the address. Nationally the average was 74 percent. Rick Quayle, son of Mr. and Mrs. Ted Quayle of Weldon, received his diploma from Professional Business Institute during graduation at Joyce Memorial Methodist Church in Minneapolis, MN, He was enrolled in the School of Medical Laboratory and X-ray Technician. Quayle immediately began working at the Leon Clinic. Clarence Boord and Sons, Inc., manufacturer of insecticides and household chemicals in Leon was an exhibitor at the Omaha Products Show. The show featured over 400 exhibits. Five new products were planned for 1970 introduction. Sales for the fiscal year were up 37%. Mrs. Donald Leak joined the staff as a secretary. Airman Kenneth Hill, son of Mr. and Mrs. Roy Hill completed basic training at Lackland AFB Texas. Airman Hill was taking further training to be a security policeman. Private Doug Young, son of Arlene Young of Leon, was taking basic training in the U.S. Army, at Fort Polk, LA. Mr. and Mrs. Joe Schoch and children, Anne and Randy, moved to Columbus, OH, where he assumed his position as general manager of the Hart Manufacturing Company with plants in Eaton, Gallion and Columbus. Schoch was the former manager of O'Bryan Brothers, Inc. Factory in Leon. A man from Afton went into a tavern in Grand River, pulled out a revolver and fired a shot into a wall. He was later arrested by Sheriff Slim Houck. He was charged for carrying a concealed weapon.

75 YEARS AGO (September 29, 1944) Leo Hoffman left Leon – Leo C. Hoffman, 50 Years Ago member of the Leon (October 2, 1969) high school faculty, reHarold Schneider signed his position as was hired at the Deca- principal to accept a tur County State Bank better position with

the Huntington, Ind. School. His wife, who was secretary for Martha Hoffman, county attorney, remained in Leon to complete her work and attend to business matters here for a while. Eva Curry did the work Mr. Hoffman was doing. A meeting was held at the courthouse where preliminary plans were discussed and committees appointed to complete arrangements for Leon's new airport. A contract was signed for the purchase of eighty acres of land three miles north of Leon adjoining the pavement on Highway 69. Forty-one businessmen and others gave the project its financial support and work was underway. Pastor at Christian Church – The Leon Christian church secured Rev. W.R. Watkins of Minneapolis as pastor for the congregation. Rev. Watkins came to Leon from the Audubon Park Christian Church. Rev. Watkins, his wife and son, Richard, moved to Leon. They occupied the Leon Carter residence property as a parsonage. Mr. and Mrs. Robert Davis of Oregon were the parents of a daughter. Anna Clifton of Des Moines was a guest at the home of Mr. and

100 YEARS AGO (October 2, 1919) $10 for Best Corn – Three prizes were given of the best twelve ears of corn brought to the real estate office in Leon, divided into three prizes, $5 to first, $3 to second and $2 to third. Wanted this corn to show prospective buyers what kind of corn Decatur county can raise announced C.M. Akes. When the Harris family of San Pedro drove their car around the base of a side hill in Santa Ana Canyon, a bull grazing on the hill, snorted and decided to engage in combat with the Ford car in

which the Harris family was riding. After the bull had turned the car upside down in the road, he strolled into the nearby trees. The members of the Harris family were not hurt, so rolled the car over onto its wheels and continued on their journey. Decatur County Aviator was Injured – Decatur friends received word from Mrs. Eber LaPorte of Fairview, Okla. stating that she received a telegram from Washington, D.C. saying that her brother Esten Koger, while flying from New York City, had been injured when his plane fell. His injuries were not considered serious. Esten Koger was formerly a resident of Decatur City and had many friends in this vi-

Patricia Dunn. Laurie Carpenter was also home for the night. Cassie Daleske and Andrew Lane attended Rachel and Dakota Grabill’s wedding Saturday night. They also have a car stuck in the mud. Imagine that! Dylan and Holly Parkhurst also attended Dakoka and Rachel Grabill’s wedding Saturday night. Liz Carpenter got up early Saturday morning and took Jimmie Carpenter and Patricia Dunn to Des Moines so they could catch their bus tour group and head east for a fall tour. When Liz returned home, she and Laurie Carpenter headed south to Independence to stay at Jimmie Carpenter’s house Saturday night. While in Independence, Liz and Laurie attended the last two games of the Kansas City Royals’ 2019 baseball season. They returned home Sunday evening. Jaime Reyes, nephew of Philinda Snethen spent Saturday evening with his aunt Philinda. Little Benson Parkhurst had his pictures taken Sunday. He’s starting to get his cough back so Mom and Dad have him back to breathing treatments again. Get well, Benson! Ivan Lane’s news this week was ten inches of rain! Have a good week, be kind to each other, and keep your rain boots, raincoat, umbrella, and maybe even your kayak or canoe or fishing boat and oars handy this week. More rain is on the way!

MARGARET GIBSON Well, here we are in October and what do we get, torrential downpours! The Andover area had over eight inches of rain last weekend! Rained so bad it washed out a rural water line and folks were without water from Sunday afternoon till Monday late afternoon. I guess we should at least be thankful that all the ponds will be full and the rains came now instead of three months or so from now! Chad, Haylie, Cotton, Coy, and Cole Osborn visited Sandy and Gary Osborn on Friday night and Cotton and Coy spent the night. Friday night Teeny Gibson and son Steve Gibson stopped by and visited with Philinda Snethen. Later that evening they met at Crown Colony for a get together to help Teeny celebrate her birthday. Also helping her celebrate was her sister Norma Ward and niece Mary Jones. Her age is the second prime number times the eleventh prime number. (Hint: It is more than nine decades and less than nine and a half decades.) Happy Birthday, Teeny! Liz Carpenter attended the Lamoni High School homecoming football game on Friday night. Patty's Back Door and discussed their first event, which will be a Halloween party for their group, as well as volunteer opportunities in the community. They have settled on the name, "Teen Council" for their group. We had 15 kids in attendance, and we are looking forward to more next time! LINDA BOOTHE My Tuesday afternoon visitors on the porch were Rick Boswell and his granddaughter, 14 month old, Miss Luci. I was so glad to finally meet Luci and get acquainted with her. Friday evening, Alta Graham, Carol Benedict and I all bravely ventured out to eat with the potential of severe thunderstorm warning pending. We braved the heavy down pour and didn’t even melt when we got wet. We had an enjoyable meal and some fun despite the weather. Miss Libby Lee Jane Kraus celebrated her 1st birthday on Saturday, Sept 28th, at the Davis City Community Center. Libby’s unicorn themed party was attended by family and friends. The family grilled hot dogs and enjoyed unicorn cupcakes and homemade ice cream, made by great-grandmother, Judy Waddell. Libby’s actual birthday was Sept 16th. She is the daughter of Trista Waddell and Randan Kraus, and the granddaughter of Rodney and Shannon Waddell, all of Davis City. Greatgrandparents are Ron and Jane Thompson of Davis City and Charlie and Judy Waddell of Lamoni. Rod and Brenda Boles celebrated an anniversary on the 29th. Congrats! Boys XC Moves Up to #12

The high school girls had a very strong pack of 4 in the top 16, lead by Kaydee Swartz earning a medal in 7th with a time of 22:33 at Eddyville.

------------------------------The high school boy's cross country team is making a name for themselves as they moved from #15 to the #12 ranked team. As of Tuesday, September 24, the team is ranked 12th in Class 2A, according to the Iowa High School Track and Field and Cross Country Coaches Association (IATC). ------------------------------By Coach Reece Tedford Last Tuesday, at Eddyville, the HS girls had a very strong pack of 4 that was as good as anyone's with 4 in the top 16. All of those girls ran season bests or PR's. It was a strong team effort for the ladies. Kaydee Swartz (7th-22:33), Harrisen Bevan (13th-23:31), Isa Cote (15th-23;35), and Lauren Saxton (16th-23:38) made up the strong pack up front. Mya Applegate finalized the scoring effort for the Cardinals (34th-26:47) and Maren Buckingham (36th-26:51) continues her strong season. Chloe Hamaker (45th-28:56) rounded out varsity efforts. JV girls ran well also with Grace Poulton in 3rd-26:55, Audrey Lloyd in 5th-28:44, Carson Bethards 6th-29:04, Ellyson Sheetz in 8th-30:52, and Rian Bevan in 11th-36:42. The JV girls did win their division. The HS boys ran against #5 Albia and ran rolid but man for man just got beat by the higher ranked team. William Gillis (4th-17:15) led the way with a big PR and moves into 4th all time on the CD 5K performance list. He was closely followed by Tate Swartz (6th-17:35) who also picked up a medal. The scoring pack came in together with Vincent Carcamo (13th-18:30), Junior Oesch (15th18:33), and Tyson McDole (16th-18:36) just outside the top 10. Vincent Carcamo led that final scoring pack again and has run well recently. Matthew Patience with a time of 20:03 (27th) and Jack Greenwood 20:17 (29th) also ran well for the Varsity team. JV boys were led by Brayden Olsen who won the JV race with a PR of 19:46. Other JV runners who ran well in the JV race were Quinton Coffelt (10th-21:45), Nathaniel Bishop who ran a PR (11th-21:59), Isaiah Brunk who also ran a PR (12th-22:10), and Ashton Gregg (16th-23:14) who ran a season best.

Cardinals Rout North Mahaska 50-12 The Cardinals opened up District play with a commanding win over North Mahaska there Friday night 50 -12. With this victory, CD is now 2-4 overall and 1-0 in league play. The Cardinals were without Cole Pedersen and Dakota Reed, who suffered minor injuries the week before, but are planning to return for the homecoming game this Friday night against Lynnville-Sully (0-6). “I was very proud of how we battled and executed with our two main runners out of the game,” stated Coach Jon Pedersen. “Other than a couple of long passes our defense was stout the whole night. It was a great team win.” The Cardinals jumped out to a quick 26-6 lead in the first quarter and extended the lead to 38-6 by halftime. After the break, CD added 12 more, while holding their opponent to a touchdown in the third frame. Neither squad scored in the fourth. The Cardinals controlled the pace of the game from the air as Matthew Boothe, in the absence of Pedersen, stayed behind center for the night. Cardinals Snap Losing Streak The Cardinal netters hosted the Southeast Warren (SEW) Warhawks last Tuesday, September 24. The three games were close, 15-25, 20-25, and 1925, but the Warhawks walked away with the win. The Cardinals continue to work to find their groove in their new rotations for the season. A few points later Alley hammered an ace serve in, 11-18. Applegate worked in a nice tip but the Cardinals just couldn't quite gain the lead, losing 15-25. The Warhawks had the momentum earning a strong 9-2 lead. The Cardinals were able to steal their momentum, demonstrating an immense amount of hustle while taking advantage of the Warhawk errors, bringing it to a one point game, 8-9. Returning from a Warhawk time-out, the Cardinals grabbed the 13-11 lead including a corner shot ace by Alley and a kill by Hamaker. The battle of the points continued with Alley hammering another kill for the 15-14 lead. On a couple Cardinal errors of hitting into the net as well as shanking the receives along with a few key plays by the Warhawks, the Cardinals lost the lead and the game, 2025. The third game started similar to the second with the Warhawks 12-4 lead. Following a CD time-out, the Cardinals found their strong rotation bringing it back to a game of 10-15, lead by a nice deep free ball return by Hamaker, Lyndsey Dale with an ace serve, and Lindsey with a well placed kill right on the line. The Cardinals were hustling coming up with some hard saves. Seniors Lindsey who was able to return a low (right over the net) free ball for the point, Applegate with a kill and Morgan Nordyke with a solid kill keeping the game close

with the score, 17-23. Unfortunately, on some simple no talking errors at the end, the game was lost, 19-25. Hamaker lead the night with 4 kills followed by Alley with 3, Applegate 2 and Lindsey and Nordyke with 1 a piece. Lindsey recorded 7 assists and Nordyke 1. Carlee Hamilton lead with 11 digs, followed by Nordyke with 9, Lindsey 5, Dale 4, Applegate and Addie Graham with 3 each, and Alley, Mara Dykes and Hallee Hamilton 1 a piece. Ayr, East Mills and Sidney in the pool play and Murray in the final tournament game. The Cardinals ended their day with a win against the Murray Mustangs, 25-19 and 25-22. On Friday, the student council will hold a tailgate lunch in front of the North Elementary and High School for students in grades 3-12. Events will be class activities and spirit games combined with the pep assembly in the gym. Then, the entire student body will be dismissed downtown to line up for the Homecoming Parade which will begin at 2:30 p.m. and follow the usual route. That night, the

Central Decatur Cardinals will take on the Lynnville-Sully Hawks beginning at 7:00 p.m., followed by the dance for the middle school and high school students at the CD high school commons. Pregame performance by the band will begin at 6:40. The introduction of this year's Homecoming Royalty will be around 6:45 p.m.

followed by the introduction of Austin Gibson as the Honorary Captain. During halftime of the football game Friday night will be performances by the Dance Team, Cheerleaders and Flag Corp. Halftime will conclude with the introduction of this year's honorees: the 2004 Playoff Football Team members along with the Class of 1979.

Vaughan Smyth Reminisces (Continued from Sept. 25, 2019 issue)

First Written in the May 22, 1969 The Leon Journal-Reporter issue Chapter Three (continued) Now, Saturday nights were real big in Leon. The band played in the bandstand which stood on the southwest corner of the courthouse square. We had large crowds come in from everywhere. There were five grocery stores running at one time and we had a bakery that shipped bread all over the county by train. Speaking of trains, we had eight passenger trains and four freights going through Leon every day, and had a bus that met the trains and bring passengers up town. Leon was a favorite stopping place for traveling salesmen and the old Hotel Leon, which stood where the present Hotel Leon was, was full of them most of the time. We had a Large Opera House that stood on the ground where the DX Station was. It was on the second floor, seated around 600 persons and some of the best road shows in the country came to Leon. The Opera House was a community center. It had a large stage and the high school, not having a gymnasium at the time, held all their graduation exercises there, also on Memorial Day, the members of the G.A.R. always held a program there before they marched out to the cemetery to put flowers on the soldiers' graves. In 1912, Maud and Orel Estes opened a Ford dealership in a new building across from Hotel Leon. At one time, there was a hotel on the same site. Estes also had a cut-rate grocery store in one of the storerooms under the Opera House. They also ran a 5 cent movie in the opera house. In the year of 1923, the whole block burned, Opera House, Hotel Leon, Bowshers Implement Store next to the hotel on the south side. Then the present Hotel Leon was built on the same spot. By the time I was 14 some of the Leon boys started what was then called the Lone scouts. (It preceded the Boy Scouts). I was the oldest one, so the boys appointed me chief (Scout Master). About that time, I bought a printing press and did quite a bit of printing. We started a

scout paper. In those days, all Lone scouts were in tribes and they had a name. Ours was called the Mink Trive so we called our paper the Mink Monthly. Now all tribes in the Untied States had papers. We used to meet in the basement of the Library every Monday night and had some real times. Sada Stout was librarian and she was sure nice to us. We used to go on lots of hikes and had some real cookouts. Some of the members were Marion McIntosh, Virgil and Francis Cherrington, Ronald Fisher, Ronald Coleman, whose father was the Brethren minister, Marion Osborn, and several other boys I can't think of. In about three or four years, the Boy Scouts started and our Lone scouts passed on. I had kept the paper going and decided to change the name to the American Scout. By that time, we had subscriptions sold all over the country. We had about 500 subscribers. By that time it took a lot of work to get it out which had to be done after school and on Saturdays. We got the Leon Journal to set some type on their linotype and that saved a lot of work. I kept the paper going and did odd job printing which made me $15.00 a week while I was still in school. Our Presbyterian minister, the Rev. Thomas Campbell, was Boy Scout Master and I went to that church, have been a member for nearly 50 years. I used to go with them on hikes and cookouts, and had lots of fun. About 1917, a man by the name of Campen came to Leon and built a theatre on the north side of where the Western Auto store was. It was a real nice theatre. I got a job taking tickets and he let me put my printing press in the back basement and I printed all the handbills for the Theater. He was a photographer and had a studio over where the Locker Plant was. He did a lot of his finishing in the basement of the theatre. That is where I got my beginning as a photographer. He taught me a lot about photography. Roy Gunter was his operator and I learned how to run the projectors from him. Remember, all this time I was in high school and remember I also took a little time to go to ball games and school activities. Well, 1918 came and the first World War was

on. I was 18 in September, was drafted and called up to take the examination in November. The war ended and I never had to go. (But I made World War II). During the war one of the Leon boys died in camp and they brought him back to Leon to bury him. Everything in town was supposed to close. The theatre was running a matinee and in those days of silent movies the theatre had an electric piano. It was going full blast when the funeral procession went by the theatre. That night somebody threw yellow paint all over the front of the theatre. That about ended the business. Now, Bill Lindsey had the old "Idle Hour" theatre running where the present Strand stands. He bought out Campens theatre called "The New Theatre" and ran it part of the time, then sold the equipment and the building was remodeled into a store room. This is where I got in the photographic business. Campen wanted to leave town and told me that he would sell out cheap $200 - so, without telling my folks, I went to the bank and told Fred Teale who ran the Farmers and Traders Bank about it and he loaned me the money to buy it. By that time, I was in the 12th grade in high school, so, like a fool, I quit school and started to run the studio. I have regretted it all my life that I did not finish school and get my diploma. I sure got it at home but it was done so they let it pass by. In the summer of 1919, Roy Gunter came to me and said he knew where we could buy a movie machine, some seats and a screen. We bought it on payments from Fred Teale's son-in-law in Garden Grove. We moved it to Davis City and rented Sutherlans' Hall. We ran it on Wednesdays and Saturdays. Business was good. Then, one day the gates Bank in Davis City folded up and we lost all our money. I had a little money and I bought Roy out

as he had another job running projectors at Creston. I ran the theatre until the following spring, then sold it to a man from Seymour. In the meantime, I had been trying to run the studio in Leon. Business was not very good. In May of 1920, the Idle Hour Theatre in Leon was sold to Abe Frankel, who owned several theatres in Des Moines. He got his sister from California to come and run the theatre. On the night of May 31, the boys that were operating the projectors, decided to quit and someone told Miss Frankel I could run the projector. I got the job and stayed in the theatre for 30 years working for different people who bought it from time to time. I moved the studio upstairs where the Rippey's apartments were. Then after a few months I moved over to the second floor over where Graham's Department Store was. I was there for several years when World War II came and I enlisted in the Navy. I had a girl working for me and she said she would run the studio for me. She took pictures and finished them. Did a real business. When I came back from the Navy the studio was still going strong. In 1946, I built the present building where I have the studio. In 1969, I have been in the studio for 50 years.

Chief Thomas' Use of Deadly Force Justified (continued from page 1) making no attempt to flee the area. Thomas exited his patrol car, while holding one eye open with one hand, and holding his firearm in the other, he approached Bauer’s car and directed him to show his hands. Bauer not only refused to comply, but responded by yelling profanities at Chief Thomas. Chief Thomas assessed that Bauer was rummaging through the console of his car and believed that he was searching for another weapon to use against Chief Thomas. Chief Thomas fired one shot through the left rear window striking Bauer in the back. Only then did Bauer comply with the directions of Chief Thomas, show his hands and exit the vehicle. Chief Thomas had called for back-up after the initial shots and other officers arrived on scene almost im-

mediately after Bauer was shot. Those officers attended to the injuries of both Bauer and Chief Thomas and provided medical aid while the ambulance was in route. Bauer was treated at the Decatur County Hospital and then transported by air ambulance to Mercy Hospital in Des Moines, where he was treated for non-life threatening injuries and later released. After a full investigation, Patrick Bauer was charged with Assault on a Peace Officer with Intent to Inflict Serious Injury and Possession of Methamphetamine. He is being held in the Decatur County jail on $50,000 cash only bond. After a thorough review of the case file, and consultation with neighboring county attorneys, it is the opinion of the Decatur County Attorney that Chief Thomas was justified in his use of deadly force and there will be no criminal charges filed against him.
