Yukta granted divorce, HC quashes case against her husband after ‘settlement’

On July 3, 2013, Mookhey filed a case against her husband, parents-in-law and sisters-in-law under Sections 498A (cruelty) and 406 (criminal breach of trust), and also 377 (unnatural sex) against her husband.While Tuli’s family members were granted anticipatory bail by a sessions court, his plea was rejected, following which he approached the HC seeking anticipatory bail. The HC then suggested the couple go for mediation and attempt to resolve their disputes.

Court-appointed mediator advocate Rajiv Patil had handed over the consent terms in a report to the High Court on March 26, 2014. The court accepted the report whilegranting anticipatory bail to Tuli in a domestic violence case filed by Mookhey against him. “The divorce petition filed by Tuli in Nagpur was transferred to the Bandra Family court and it culminated into a divorce by mutual consent yesterday,” Mookhey’s counsel, Jamshed Mistry said.

The couple informed the court that they reached an amicable settlement following which Tuli was granted anticipatory bail. Filji Fredrick and Taubon Irani, lawyers for Tuli and Mookhey respectively, had informed the court then that the settlement conditions had been finalised and the duo mutually decided to withdraw cases filed against each other.

Both parties consequently filed a petition in the HC seeking quashing of the cases registered against them. The court quashed the FIR registered against Tuli while directing the police to handover the property under dispute to the respective parties as a result of the settlement.
